Terms of sale

The owner of the online store KariniButiik.ee (hereinafter the Online Store) is OÜ K&N (registration code 12920674), located at Suve 2 Tallinn.

Validity of sales conditions

The terms of sale apply to the purchase of goods and services from the KARINIBUTIIK.EE online store between the buyer (hereinafter the Consumer) and the company K&N OÜ (hereinafter the KARINIBUTIIK.EE Online Store).

In addition to these terms and conditions   legal relationships arising when purchasing products from the KARINIBUTIIK.EE online store are governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.

Online store   KARINIBUTIIK.EE reserves the right to make changes to the terms of sale. The mentioned changes are reflected on the website www.karinibutiik.ee

Price information

All prices shown in the online store   .KARINIBUTIIK.EE are in euros and include VAT.

The cost of transport is added to the purchase price according to the delivery method chosen by the Consumer.

Prices are valid from the time the order is placed until the payment deadline for the placed order expires (1 day after the order is placed).

If the order is submitted before the sales conditions or prices are changed, the legal relations between the Consumer and K&N OÜ will be subject to the conditions valid at the time the order was placed.

Forming the order

To order the goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and choose the appropriate method of product delivery. The amount of the fee is then displayed on the screen, which can be paid via a bank link or using another payment solution. Details for making a euro payment, including all applicable national taxes and additional fees, can be found on the invoice displayed on the screen after confirming the order. An order confirmation with an invoice will also be sent to your registered e-mail address.

Fill in the data and the cells on the order confirmation page carefully, because the speedy and trouble-free delivery of your purchased products and the subsequent resolution of disputes and claims depend on the accuracy and correctness of the information provided.

The contract enters into force from the receipt of the amount to be paid to the current account of the Online Store.

If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned, generally within 1-2 working days. Depending on the payment method, it may take up to 7 working days to arrive.

The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.

Entry into force of the sales contract

With the contract of sale of goods, the online store  KARINIBUTIIK.EE undertakes to hand over to the Consumer the existing Goods, which are manufactured or acquired by the online store  KARINIBUTIIK.EE in the future, and to enable the transfer of ownership to the Consumer, while the Consumer undertakes to pay the online store  KARINIBUTIIK.EE for the Goods the amount indicated on the presented invoice and accept the Goods.

Orders that have not been paid for will be canceled 1 day after the order was placed.

The sales contract enters into force after the payment made by the Consumer is received in the bank account of K&N OÜ.

Delivery

Goods are sent to the following countries: Estonia, Latvia, Lithuania, Finland

The shipping costs of the goods are borne by the buyer, and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally arrive at the destination specified by the buyer within 1-3 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 3-7 calendar days. In exceptional cases, you have the right to deliver the goods within 30 calendar days

The online store KARINIBUTIIK.EE is not responsible for the delay in the delivery of goods if the goods have been handed over to the logistics partners on time, but the delay in delivery is due to circumstances that the online store KARINIBUTIIK.EE could not influence or foresee.

Force Majeure

The online store KARINIBUTIIK.EE is not responsible for damages caused to the Customer or the delay in the delivery of the goods in the event that the damage or the delay in the delivery of the goods is due to circumstances that the online store  KARINIBUTIIK.EE could not influence or foresee.

Online store   KARINIBUTIIK.EE is not responsible for color differences due to screen settings.

Processing of personal data

By entering data in the online store and with the corresponding confirmation, the Consumer gives the right to collect and process the Consumer’s personal data (name, contact phone number, package delivery and/or home address, e-mail address) and to transmit personal data to the logistics partner for the delivery of the goods.

The online store  KARINIBUTIIK.EE has the right to use the address of the Consumer’s home or location to transmit advertising and other information to the Consumer.

The consumer has the right to prohibit the collection and use of his personal data at any time, unless it is necessary to collect a claim arising from the contract or to deliver the goods.

The use of electronic personal data for direct mail takes place only if the Consumer has given separate consent for this on the website  KARINIBUTIIK.EE (to the direct mail module)

Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal bank credentials, and the Online Store does not have access to them either.

Intellectual property and its use

All intellectual property   on the KARINIBUTIIK.EE website and Facebook and Instagram fan page is the property of K&N OÜ and protected by copyright law.

It is prohibited to copy, distribute, publish for commercial purposes, use in mass media or in any other way without the consent of the author.

Procedure for submitting claims

The online store is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the buyer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. It is the Webshop’s responsibility to refute the corresponding assumption.

In the event of a defect, the buyer has the right to contact the online store within two months at the latest, by sending an e-mail to the address sämäsä@karinibutiik.ee or by calling the phone number: +372 56 14 14 97.

The online store is not responsible for defects that have occurred after the goods have been handed over to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Webshop will return all fees associated with the sales contract to the buyer.

The online store responds to the consumer’s complaint in writing or in a form that enables written reproduction within 15 days.

Direct marketing and personal data processing

The online store KARINIBUTIIK.EE uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. Online store KARINIBUTIIK.EE  Transfers personal data to companies providing transport services in order to deliver goods.

The online store KARINIBUTIIK.EE  will send the buyer newsletters and offers to the buyer’s e-mail address only if the buyer has expressed his desire to do so by entering an e-mail address on the website and has indicated his wish to receive direct mail notifications.

The buyer can opt out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

Solving arguments

If the buyer has any complaints about the Online Store, they must be sent by e-mail to the address teussom@karinibutiik.ee or by calling +372 56 14 14 97. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee (Endla 10A, 10122 Tallinn; phone 6201 707; e-mail avaldus@komisjon.ee) You can familiarize yourself with the procedural conditions and submit an application here. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Store. Review of the buyer’s complaint by the commission is free of charge.
